1. Acceptance of Terms
These Terms and Conditions form a legally binding agreement between you ("you" or "User") and Kubo ("PolicyPurse," "we," "us," or "our") governing your access to and use of the PolicyPurse mobile application, any related websites, and all associated features and services (collectively, the "Service").
By creating an account, downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you are using the Service on behalf of a household, family, or other group, you represent that you have the authority to bind that group's members to these Terms with respect to any shared content.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and capable of forming a binding contract to create an account and use the Service. The Service is not directed to children under 16, and we do not knowingly permit account creation by anyone under that age. By using the Service, you represent that you meet these requirements.
3. Accounts
3.1 Registration
You must create an account to use most features of the Service, using email/passwordless sign-in or a supported social/SSO provider. You agree to provide accurate, current, and complete information and to keep it up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including any biometric/PIN app-lock you configure. Notify us immediately at team@buildwithkubo.com if you suspect unauthorized access to your account.
3.3 Household Accounts
If you use household sharing (available on eligible subscription tiers), you may invite other individuals to join your household group. You are responsible for ensuring you have the right to share any document or information with invited members, and for understanding that invited members may view, and depending on permissions, edit or delete shared content. We are not responsible for disputes between household members regarding shared content.
4. The Service — Description and Disclaimers Specific to Core Features
PolicyPurse helps you capture, organize, and understand insurance policies, warranties, receipts, and related documents, and provides reminders and guided checklists. The Service is an organizational and informational tool. It is not insurance, does not provide insurance coverage, and does not replace your insurer, broker, financial advisor, or attorney.
4.1 The Vault
You are solely responsible for the documents you upload, their accuracy, and your continued possession of original documents (we recommend retaining your own copies of critical originals outside the App). We use OCR and AI models to extract suggested fields (dates, coverage details, provider names, etc.); these are suggestions for your convenience, may contain errors, and you should verify all extracted information, especially before making any decision or taking any action based on it, against your actual policy or warranty document.
4.2 Ask AI
Ask AI is an AI-generated conversational feature that answers questions based on documents in your Vault (and general, non-personalized information for definitions or process explanations). Ask AI does not provide insurance, legal, financial, or tax advice, and its output is not a substitute for consulting your insurer, a licensed insurance professional, or an attorney. AI-generated answers may be incomplete, outdated, or incorrect, even where a source document is cited. Coverage determinations are made solely by your insurer under the terms of your actual policy. You should independently verify any Ask AI answer before relying on it for a coverage decision, a claim, or any financial commitment.
4.3 Incident Mode and Claims Prep
Incident Mode provides general guided checklists based on common incident types and information extracted from your documents. It is informational only and does not constitute legal, insurance, or financial advice, and is not a substitute for contacting your insurer, emergency services, or a professional as appropriate to your situation. Claims Prep helps you organize evidence and generate a document packet; we do not submit claims to insurers on your behalf, and we make no guarantee that any insurer will accept, honor, or expedite a claim based on materials generated through the Service.
4.4 Reminders
Reminders are generated based on dates our systems extract from your documents or that you manually enter. Reminders are provided as a convenience only. You remain solely responsible for tracking and meeting all deadlines, renewal windows, and claim submission periods that apply to your policies, warranties, and other obligations. We do not guarantee that every relevant date will be correctly detected, that push notifications will be delivered promptly or at all (due to factors outside our control, such as device settings, connectivity, or platform notification delivery), or that reminders will be sufficient to prevent a missed deadline.
4.5 No Professional Relationship
Nothing in the Service creates an insurance agency, brokerage, adjusting, legal, or financial advisory relationship between you and PolicyPurse.
5. Subscriptions, Billing, and Payments
5.1 Subscription Tiers
The Service is offered on a Free tier and paid tiers (currently "Plus" and "Household"), each with the features, limits, and pricing described in the App at the time of purchase. We may modify tier features, limits, or pricing prospectively, with notice as described in Section 5.5.
5.2 Billing Through App Stores
Paid subscriptions are billed through the Apple App Store or Google Play Store (as applicable) and managed via our subscription infrastructure (RevenueCat). Your payment relationship for billing purposes is with Apple or Google under their respective terms; we do not directly collect or store your full payment card details.
5.3 Auto-Renewal
Subscriptions automatically renew for the same term (monthly or annual, as selected) unless canceled at least 24 hours before the end of the current period, in accordance with the applicable app store's renewal policies. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. Canceling stops future renewals but does not refund the current billing period unless required by law or app store policy.
5.4 Refunds
Refund requests are handled according to the applicable app store's refund policy. We do not directly process refunds for app-store-billed subscriptions but will assist with app-store refund inquiries where required.
5.5 Price and Feature Changes
We may change subscription pricing or included features. For existing subscribers, material price increases will not take effect until your next renewal following notice, to the extent required by applicable law or app store policy.
5.6 Household Tier Storage and Members
The Household tier includes a shared storage allocation and a maximum number of members as described in the App. We may adjust these limits with reasonable notice.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Upload documents you do not have the right to upload or share (e.g., another person's confidential documents without authorization, except as reasonably necessary for household sharing you're authorized to manage);
- Attempt to reverse-engineer, decompile, scrape, or extract the underlying models, source code, or extraction pipelines of the Service;
- Use automated means (bots, scripts) to access the Service outside of any API we officially provide;
- Interfere with or disrupt the integrity or performance of the Service, including introducing malware or attempting unauthorized access;
- Use Ask AI or any feature to generate, request, or facilitate illegal, fraudulent, harassing, or harmful content, including fraudulent insurance claims;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Resell, sublicense, or provide commercial access to the Service without our prior written consent.
We reserve the right to investigate and take appropriate action, including suspending or terminating accounts, for violations of this Section.
7. User Content and License Grant
7.1 Your Content
"User Content" means the documents, photos, text, metadata, and other materials you upload or create within the Service, including Ask AI conversations and Incident/Claims data. You retain all ownership rights in your User Content.
7.2 License to Us
You grant PolicyPurse a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely as necessary to operate, maintain, and provide the Service to you (including OCR/AI extraction, search indexing, and generating Ask AI responses grounded in your documents), and as otherwise described in our Privacy Policy. This license ends when you delete the applicable content or your account, subject to the residual retention periods described in our Privacy Policy (e.g., backups, legal holds).
7.3 No Training on Your Content
We do not use your User Content to train third-party foundation models, and our AI vendor agreements contractually prohibit such use, as described in our Privacy Policy.
7.4 Feedback
If you provide us feedback, suggestions, or ratings (including Ask AI thumbs up/down feedback) about the Service, you grant us an unrestricted, royalty-free right to use that feedback to improve the Service without any obligation to you.
8. Intellectual Property
The Service, including its software, design, trademarks, logos, and all content we create (excluding your User Content), is owned by PolicyPurse or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you in our intellectual property.
9. Third-Party Services
The Service integrates or relies on third-party providers, including cloud infrastructure and database hosting, AI/LLM processing, subscription billing, and analytics (as further described in our Privacy Policy). Your use of the Service may be subject to those providers' own terms where you interact with them directly (e.g., app store billing terms). We are not responsible for the acts, omissions, or availability of third-party services beyond our reasonable control.
10. Third-Party Links, Benefits, and Information
The Benefits tab and other features may reference third-party entitlements (e.g., "travel insurance included with your credit card") or link to third-party resources. We do not verify, endorse, or guarantee the accuracy of third-party benefit information, and any reliance on it is at your own risk; always confirm entitlements directly with the relevant provider.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) OCR, AI EXTRACTION, OR ASK AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) REMINDERS WILL BE GENERATED OR DELIVERED FOR EVERY RELEVANT DATE; OR (D) ANY DEFECTS WILL BE CORRECTED.
YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN INACCURACIES AND THAT YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE RELYING ON IT FOR COVERAGE, CLAIMS, FINANCIAL, OR LEGAL DECISIONS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, and you may have additional rights under local law.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
IN NO EVENT WILL POLICYPURSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING BUT NOT LIMITED TO A MISSED RENEWAL OR CLAIM DEADLINE, A DENIED INSURANCE CLAIM, OR RELIANCE ON AN INACCURATE AI-GENERATED ANSWER OR EXTRACTED FIELD — REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) [USD $100].
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless PolicyPurse and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) User Content you upload, including any content you were not authorized to share; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
14. Termination
14.1 By You
You may stop using the Service and delete your account at any time via in-app settings. Deletion will proceed as described in our Privacy Policy.
14.2 By Us
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or if required by law. We may also discontinue the Service or any feature at our discretion, with reasonable notice where practicable.
14.3 Effect of Termination
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 7.3, 8, 11, 12, 13, 16, and 17) will survive.
15. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app notice, email) before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes, to the extent permitted by applicable law. If you do not agree to updated Terms, you must stop using the Service and may delete your account.
16. Dispute Resolution
16.1 Informal Resolution
Before filing a claim, you agree to first contact us at team@buildwithkubo.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within [30] days.
16.2 Arbitration Agreement [Jurisdiction-Dependent — Confirm Enforceability With Counsel]
If a dispute is not resolved informally, you and PolicyPurse agree that it will be resolved through binding, individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. YOU AND POLICYPURSE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. 16.3 Governing Law

17. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PolicyPurse regarding the Service and supersede any prior agreements.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure. We are not liable for delays or failures caused by circumstances beyond our reasonable control.
- Export Control / Sanctions. You represent that you are not located in a country subject to a U.S. government embargo or listed on any U.S. government restricted-party list, and that you will comply with applicable export control and sanctions laws.
- App Store Terms. If you access the Service through the Apple App Store or Google Play Store, you also agree to comply with the applicable platform's terms of service. In the event of a conflict between these Terms and platform terms as to platform-specific matters (e.g., refund handling), the platform's terms will govern that specific matter.

18. Consumer Rights Notice (Region-Specific — To Be Completed)
Depending on your launch markets, consider adding or confirming:
- EU/UK Consumer Rights — statutory withdrawal/cooling-off period disclosures for digital subscriptions, and confirmation that any waiver of withdrawal rights (e.g., for digital content "used" before the cooling-off period ends) is properly obtained.
- US State Auto-Renewal Laws — several states (e.g., California, New York) impose specific disclosure and cancellation-mechanism requirements for auto-renewing subscriptions beyond app-store defaults.
- Insurance Regulatory Disclaimers — confirmation from counsel that PolicyPurse's positioning (organizational/informational tool, not an insurance agency, broker, or adjuster) is accurately reflected and sufficient under the insurance regulatory regime of each launch state/country.
- Platform-Specific EULA Requirements — Apple requires either your own EULA or reliance on its Standard EULA; ensure consistency between this document and your App Store Connect / Google Play Console submissions.
